Is Tegeltija worse than Osmica?

Judicial-political parallel analysis of two intriguing cases

At a press conference, the president of the HJPC, Milan Tegeltija, announced that he would resign from this position. This is the result of several months of pressure that reached its peak with the "Horseshoe 2" affair, that is a video in which Tegeltija allegedly promised his colleague from the Council Milijana Buha a job as a judge in the District Court in Banja Luka for her sister Sanja Čegar, after which the highest international B&H officials openly demanded his resignation.

Illegal recording

Although the President of the HJPC has always claimed that this is a montage, directly backed by OSA, the outgoing President of the HJPC himself has, in the opinion of the international community, given enough reason to bring himself into this position.

In addition, Tegeltija was objected to the first, no less compromising video, which concerns bribery, and there are accusations of political appointments of judges and prosecutors, then his constant emphasis that he represents Republic of Srpska, private behavior that does not befit a holder of such office, etc. But even if we leave Tegeltija's character aside, the public must be aware that illegal recording, monitoring, sending threatening messages, which he, as he testified, has been a victim of in recent months, is inadmissible.

Another, very important question that should be asked is that, if the already mentioned accusations are a sufficient reason for him to resign, then what about the cases when a high official is under investigation or is officially accused of performing his function outside the law, that is without a proper education, and uses the resources of the intelligence service for a brutal confrontation with individuals, political rivals of the SDA, or participates in the illegal appointment of personnel?


Is there a motive

Of course, in this particular case, it is about Osman Mehmedagić, the director of the Intelligence and Security Agency, who, as he says, has completely put himself in the service of his political patron Bakir Izetbegović, the president of the SDA, and his showdown with political opponents.

But, unlike Tegeltija, the lack of a diploma and the collection of an already confirmed and expected indictment against Mehmedagić (and his patrons) is not a sufficient motive to save at least the remaining gram of honor, first to himself, then to the institution he leads, and above all to the state of B&H, and resigns. And, unlike Tegeltija, Mehmedagić does not tolerate even some of the pressures and demands for withdrawal to which the President of the HJPC was exposed. Some portals published unofficial information yesterday that Izetbegović, from international circles, was told that there was no reason to insist on the reappointment of the current head of the Intelligence Service.


Preserve the integrity of institutions

Of course, many believe that it is not questionable that Tegeltija gave enough reasons not to be the head of this institution anymore, which is confirmed by the relevant international institutions. But, if we adhere to European standards and preserve the integrity of state institutions, then we must also act politically just in other cases, where the situation, at least when the accusations of illegality are in question, is much cleaner.
