The Court of B&H rejected the indictment of the Prosecutor's Office of B&H against Osman Mehmedagić, Director of the Intelligence and Security Agency (ISA), Selmo Cikotić, Minister of Security of B&H, and Muriz Druškić, Advisor to the Director of ISA, the Prosecutor's Office confirmed for „Avaz“.

They are accused in the "Security Checks" affair, which refers to embezzlement in connection with the appointment of members of the Commission for the Second Instance Resolution of the Security Checks for Police and Civil Servants.

The indictment was filed on December 14th last year, and the Prosecution filed an appeal against this decision of the Court, within the legal deadline.

This is a new indictment against Mehmedagic for abuse of office. The indictment alleges that Mehmedagić and Druškić decided to establish control over the revocation of security licenses for security sector employees, not guided by the interests of their service, but by the personal and political interests of the ruling political option at the B&H institutions.

This information was officially confirmed by the Court of B&H today.

As it was said, the Prosecutor's Office of B&H timely filed an appeal against the said decision, which was rejected as unfounded by the decision of the out-of-court chamber on January 4th, 2021., which confirmed the first instance decision.

The appeal of the Prosecutor's Office of B&H in no way challenged the legality and regularity of the first instance decision.

- Out-of-court chamber fully accepted the arguments from the first instance decision, and in the appeal procedure, once again questioning the allegations of the Prosecutor's Office of B&H, determined that the conclusion on the absence of reasonable suspicion is completely correct, ie that the indictment does not meet the basic condition for confirmation. The chamber found that the submitted evidence in relation to the suspects Mehmedagić, Druškić and Cikotić did not establish a grounded suspicion that the essential characteristics of the criminal offense of abuse of position or authority had been achieved - it is stated.
