Prosecutor Hasanspahić said that 16 witnesses asked for protection

A hearing to extend the custody of Zijad Mutap, Alisa Ramić Mutap, Hasan Dupovac, Josip Barić and Muamer Ozegović for organized crime and cover-up of the murder of young man Dženan Memić,was held before the Chamber of the Court of Bosnia and Herzegovina, presided over by Judge Mira Smajlović, whose members were Zoran Božić and Mediha Pašić.

Namely, the acting prosecutor Ćazim Hasanspahić proposed that the custody of the accused be extended for 15 days. As a reason for that, Hasanspahić stated that the indictment was filed on July 9th, and four days later the Prosecutor's Office of B&H received a letter from the judge for preliminary hearing to submit a special proposal for extension of detention because he needs more time to study the file submitted to him for confirmation of the indictment.

- An extension of 15 days was requested so that the judge in peace could consider confirming the indictment - stated Hasanspahić.


He kept a diary and recorded phone numbers

He stated in his explanation that he was presenting a well-founded suspicion for these accused for the ninth time.

- Earlier chambers have already confirmed the allegations of the prosecution. Among them is the Appellate Panel. Police officers were involved in this case and planted evidence. Zijad Mutap led a criminal group, witness statements confirm this. He was present or familiar with every execution action. The first was on the scene in the Great Alley. Then, he meets with Barić in KCUS. He was present when Dupovac interrogated Alisa Mutap, even though she was not a minor at the time. Dupovac made it possible for them. He kept a diary. He wrote down the phone numbers and recorded the facts with which he prepared the other members of the group for further steps - Hasanspahić explained.

He reiterated that Dupovac and Mutap together acquired a Renault Clio that has nothing to do with the investigation.

- Dupovac contacted the owners of the video surveillance, asking them to give him recordings that he did not take to the Ministry of the Interior, but hid them. One tape was seized only after a month. All these recordings are relevant for shedding light on the murder of Dženan Memić - says the prosecutor.

He also explained the reasons for the detention of Alisa Ramić-Mutap.

- She was on the scene and the interrogation was in the presence of her father. She claimed she didn't remember anything. Objective evidence testifies that on the fateful night she was conscious, communicative and left home from KCUS. Protected witness M10 testified that he was at Alisa's house the next day and that she spoke about the event normally. From the findings of the ambulance, she even says which school she went to and what she ate last. She told the DKP officers who are witnesses to answer the phone because her father is calling. In the finding from March 3rd, 2016, expert witness Abdulah Kučukalić says that she did not have amnesia. That is what Professor Kemal Dizdarević said. There was no concussion which is a prerequisite for amnesia. Expert witness Hamza Mujo also said that there was no concussion - described Hasanspahić.

The prosecutor clarified that these are reputable experts who have made thousands of findings.

- This is a fake health condition - concluded Hasanspahić.

In relation to Barić, he stated that although he received an order on the fateful night, the clothes of Alisa Ramić Mutap were not completely seized.

- He took all of Dženan's clothes, even his socks, but not Alisa's bloody T-shirt, which could be use as important evidence. Zijad Mutap was also present while they were seizing clothes. He and Barić are acquaintances. He defended himself that the nurse was obliged to remove the clothes. There is a witness statement that clearly states that the medical staff delivers only what the police clearly request to be delivered, explains Hasanspahić.

For Ožegović, he says that as a member of a criminal group, he had access to video surveillance of the Crystal Hotel.

- When the police came to take the recordings on February 19th, 2016, he showed them those recordings. However, then the power goes out. This was confirmed by those police officers who are witnesses. They waited for the electricity to come, but they also told Ožegović to contact them when the video surveillance is functional again. The weekend came and when they came again the recordings were deleted and he told them it was due to a power outage. However, the recordings are made chronologically, so they are deleted. The expert witness clearly confirmed that they were deleted intentionally - says Hasanspahić.


The defense requests that the prosecutor's motion be declared inadmissible

He added that 16 witnesses have so far sought protection out of fear.

The prosecutor also said that he has influenced witnesses so far and that they have been suggested what to say in their testimonies.

Nina Kisić, a lawyer of Zijad Mutap and his daughter Alisa, stated the procedural reasons why the prosecutor's proposal should have been declared inadmissible. She also stated that her clients in the Tuzla Penitentiary are in inhumane conditions and that she has her permission to speak publicly about her health condition. Among other things, she said that she was in the sixth month of a high-risk pregnancy, that she has epilepsy and high blood pressure, and that she is blind in one eye, and that the court had that in mind when making a decision.
