Controversial director Emir Kusturica's lawsuit against "Avaz" is rejected

The B&H Constitutional Court found that Avaz's right to freedom of expression had been violated

By the decision on admissibility and merits number: AP 812/19, the Constitutional Court of Bosnia and Herzegovina accepted the appeal of the lawyer of "Avaz-roto press" company and revoked the verdict of the District Court in East Sarajevo obliging this media house to pay damages for defamation to director Emir Kusturica.

The District Court in East Sarajevo then issued a new decision by urgent procedure on April 19th, 2021, and rejected the request of Kusturica's lawyer against "Avaz-roto press" company.

We remind you that "Dnevni avaz" announced that the controversial director Emir Kusturica is coordinating the seizure of land from Bosniaks in Srebrenica in a text published on 17th of March, 2017. It is about the formation of the national park "Drina", which should merge with the national park "Tara" from Serbia and which would extend over the private estates of Bosniaks, and bypass the villages with Serbian population in a wide arc.

It is indicative that the municipalities of Rogatica and Višegrad are excluded from this project.

The B&H Constitutional Court found that Avaz's right to freedom of expression had been violated from Article II / 3 h of the Constitution of B&H and Article 10 of the European Convention for the Protection of Human Rights and Fundamental Freedoms.
